Privacy Policy

The Tel Aviv-Jaffa City Museum (the "Museum"), operated and managed by the Tel Aviv-Jaffa Municipality, attaches great importance to protecting the privacy of users of the Museum's Website, which operates at the Internet address www.taycm.org.il or at any other address operated by the Museum at its discretion and/or in all media with respect to the Museum (the “Website").

The purpose of this document is to specify the Museum's policy regarding the privacy of users of the Website, including in connection with the information about users provided by them and/or collected by the Museum on the Website, the manner in which the information is collected, stored and managed by the Museum, and the manner in which it is used. The privacy policy also includes information about the use of technological tools and other aspects related to the collection, retention, management, use, storage and transfer of information and user rights.

This policy constitutes an integral part of the terms of use of the Website and the documents that bind the user.

For convenience only, the Privacy Policy is written in the male gender, however it applies equally to both genders.

Definitions

The "Museum" – Tel Aviv-Jaffa City Museum

The "User" – anyone who browses the Museum's Website and/or communicates with it through any means of communication.

The "Website" – the Museum's Website, applications and all communication platforms with the Museum.

The "Law" - the Privacy Protection Law, 5741-1981, with all its regulations.

"Information" – any information that will be provided or collected when using the Website, including personal information and information of particular sensitivity.

"Personal Information" - as defined in Section 3 of the Law - data relating to an identified or identifiable person; for the purposes of this definition, "identifiable person" - someone who can be identified with reasonable effort, directly or indirectly, including by means of an identifier, such as a name, an identity number, a biometric identifier, location data, an online identifier, or one or more data relating to his physical, health, economic, social or cultural status.

"Information of Special Sensitivity" - as defined in Section 3 of the Law - including: Personal information about private family life, personal privacy and sexual orientation; Personal information relating to a person's health status and medical information, genetic information, bio-metric identifiers, information about a person's origin; Information about a person's criminal history; Information about a person's political opinions or religious beliefs or worldview; A personality assessment conducted on behalf of a professional body, location data and traffic data, a person's salary data and information about his financial activity; Personal information to which a duty of confidentiality prescribed by law applies;

"Anonymous Information" – any statistical/aggregate information that is collected/processed/used, which does not identify or allow the user to be personally identified.

"Third Parties - Third Party" - a party that is not the Museum and is not the user

Consent to the Provision of Personal Details and Information and the Consequences of not Consenting

As a general rule, using the Website and viewing the content it presents does not involve registering or providing personal information or information of particular sensitivity.

However, uploading content to the Website, including uploading your personal story to the Museum's collection of stories, will require you to complete a short registration process that includes providing personal information and/or particularly sensitive information and contact information. And additional details according to need and circumstances, including detailed information about the personal story - such as: date, period, memories, feelings, place of occurrence, individuals involved, etc.

Additionally, the Website may include additional registration procedures for digital services that require the provision of personal information and contact methods.

The fields that must be filled in will be explicitly marked as such, and without providing the details, it will not be possible to register for a service and/or upload a story and/or perform any other action on the site that requires identification.

Unless it is explicitly stated that the information field is mandatory and/or where there is a legal obligation to provide the information under any law, you are not obligated to provide the information and its provision depends on your desire and consent.

The user declares that the provision of such information is done of his own free will and with his consent.

Providing correct, accurate and complete information is the full responsibility of the user.

 

Before using the Website, you are required to carefully read the terms of use and privacy policy.

Use of the Website constitutes express and informed consent to all of its terms, including the collection, use, disclosure and transfer of information in accordance with the privacy policy. To the extent that you do not agree to the terms of the Terms of Use or the Privacy Policy, we ask that you not use the Website and contact the Museum by alternative means of contact, including: telephone, email, fax.

Declaration of the User

By using the Website, you declare that you are aware of and give your informed consent to all of the following:

·         The Museum collects and processes information about you - both information provided by you directly and information collected as part of your use of the Website.

·         The personal information provided by you and/or by anyone on your behalf on the Website was provided with your consent and free will, and you are aware that there is no legal obligation to provide personal information on the Website and/or to perform any action on the Website, except where otherwise stated.

·         You are aware that without providing required personal information, it may not be possible to perform an action or receive a service or use the Website.

·         The personal information you provide will be stored in the Museum's database(s), and will be used for the purposes set forth in this privacy policy, whether by the Museum and/or by third parties on its behalf. It is clarified that the Museum  will not have any responsibility regarding the receipt, storage and/or use of incorrect and/or outdated information provided to it by you.

·         To the extent that you have provided any personal information of a third party, you declare that you have received all the necessary consents from that third party in accordance with the provisions of any law.

·         The user undertakes not to upload to the Website any content or information that is confidential or legally protected by any rights, including, but not limited to, copyrights.

·         The user declares that he is aware that by uploading content to the Website, including his personal story, he grants the Museum the right to use the information at its discretion, including reproducing, copying, broadcasting, marketing and making it available to the public, all without payment and/or other consideration to the user.

Collection and Processing of Personal Information

·         In the framework of using the Website, you may be required to provide the Museum with personal information.

·          Additionally, in the framework of using the Website, the Museum may collect information regarding your activity on the Website, including personal information, through various technological means for the purpose of developing and improving the Website and enriching the content and services provided therein.

           The type of information you provide and/or collect by the Museum may vary, depending on the reason and/or purpose for which the Website is used.

·         It is clarified that without derogating from the other provisions set forth in this privacy policy, to the extent that the Website allows payments to be made, it is hereby clarified that personal information that you provide for the purpose of making payments on the Website will be transferred directly and securely to the payment and clearing provider.

It should be noted that some of the payment method data may also be stored at the Museum for the purpose of tracking and control documentation, but this is in a way that does not allow for additional charges to be made, unless express consent has been received.

·         The Museum may collect itself and/or use the services of third parties to collect, process and analyze anonymous statistical or aggregate information in connection with the use of the Website, including regarding activity on it.

·         Contacting the Museum online through the Website constitutes consent that the response will be provided online at one of the contact details you provided.

·         To the extent that you have given your consent that instead of regular mail you wish to receive notifications via email, the Museum will use the email address you filled in for this purpose.

·         To the extent that you have given your consent, the Museum will periodically send you information regarding the Museum's content and services, including surveys, newsletters, publications, etc.

Personal Information Provided about another Data Subject

To the extent that you use the Website for another person, you declare and undertake that you are authorized and have the consents required by law to perform actions and provide information for that person, in accordance with this privacy policy. 

Transfer of Personal Information to Third Parties

It is clarified that for the purpose of operating the Website and providing the services, the Museum may use the services of third parties.

Transfer of Personal Information

The Museum will not transfer personal information to third parties unless one or more of the following conditions are met:

·         When the transfer of information will be made to authorized authorities and/or pursuant to a court order and/or to the extent required for the protection of the Museum and/or in accordance with the obligations set forth in the provisions of any law.

·         To the extent required for the maintenance and operation of the Website and the proper provision of the services provided therein.

·         In the event that you violate the terms of use of the Website and/or perform or attempt to perform actions on it that are contrary to any law.

·         In the event of a dispute, claim, lawsuit and/or legal proceedings between you and the Museum.

·         In any case where the Museum believes that providing the information is necessary to prevent damage to your body or property or to the body or property of a third party.

·         Where you have given your consent to the transfer of personal information

·         Where the Museum organizes its activities and/or the Website's activities in a different framework and/or through a third party or in the event that the Museum changes its legal structure,

·         The Museum will be entitled to transfer personal information to cloud computing providers, in Israel and outside of Israel, for data storage and/or backup purposes to the extent that the Museum chooses to receive such services.

It is clarified that the transfer of information about your personal details to third parties will be limited solely to the purposes listed in this policy and as updated from time to time, and only to the extent required for this purpose at the discretion of the Museum.

To the extent that personal information is transferred to third parties for one or more of the purposes mentioned above, these third parties will be considered the data controller as defined by law.

Reference to Links

The Website may include links and references to Websites that include information and services offered by third parties, and use of the Website constitutes consent to this.  The Museum makes an effort to link to Websites that, to the best of its knowledge, protect the privacy of their users. At the same time, it is clarified that the Museum is not responsible for the terms of use and privacy policies of third-party Websites, the content of the Websites, and anything related to and resulting from their use.

Access to a third-party site and its use are under the sole responsibility of the user. Whenever you click on third-party links on the Website, the action may result in the transfer of certain information to third-party service providers relevant to the purpose of providing the service you request, all in accordance with the purposes of using the information set forth in this policy.

The Museum will take appropriate measures to ensure that third-party recipients of the information are subject to a duty of confidentiality, privacy protection, and data security with respect to the information, in accordance with all laws.

Collection and Transfer of Anonymous Information

When using the Website, the Museum collects information about the use of the Website via your computer, mobile phone or any other device you use to use the Website, which is anonymous information that does not personally identify you and cannot be associated with you.

Anonymous information may include, among other things: data about the pages you visited, type of device used, computer and connection details, statistical data about page views, traffic to and from the Website, the link/Website address from which the surfer arrived at the Website, etc.

The Museum analyzes and uses, either itself or through anyone on its behalf, anonymous information, inter alia, for the purposes set forth hereafter:

  • To enable the use and receipt of online services.
  • To improve the service experience and use of the Website.
  • For the purpose of processing statistical information by collecting and analyzing anonymous statistical or aggregated information.
  • For the purpose of securing online services.
  • For the purpose of receiving and handling user inquiries.
  • For the purpose of contacting.
  • For the purpose of fulfilling the requirements of any law.

 

Without derogating from the above, the Museum will be entitled to transfer anonymous statistical and/or aggregate information that does not personally identify you and does not allow you to be identified to third parties without any restriction. 

Retention and Storage of Personal Information

The personal information collected by the Museum is legally maintained in databases and stored with server hosting and data backup providers, in Israel and abroad.

Your consent to this privacy policy also constitutes consent in connection with the storage of information.

Using Technological Tools to Collect and Process Information

The Museum uses various technological tools within the framework of the Website to collect personal and anonymous information, for the purpose of analyzing statistical data about the use of the Website and for the purpose of improving the user's browsing experience, such as cookies, Google Analytics, etc. The Museum may also use artificial intelligence (AI) tools.

“Cookies” are small information files that are stored on the user's computer or mobile phone for the purposes of documenting how the Website is used and improving the user experience.

The Museum also uses third-party tools to analyze the use of Websites, applications, and digital services, such as: Google Analytics, Google Firebase, Google Ads, Tabola, etc.

The user of the Website can choose to change, block or delete cookie files through the settings of the browser he uses. This action may affect the use of the Website, the receipt of the services provided on it, and the user experience.

Information Security

Information security is important to the Museum and it makes an effort to ensure that the site is free of viruses, Trojan horses, and spyware. The Museum uses accepted technological and organizational security measures in accordance with the required standards to protect the information, including against unauthorized access, loss, destruction, and damage to the integrity of the information. It is clarified that the Museum cannot guarantee complete protection of the information.

The Museum operates and implements accepted procedures in the market to secure your personal information provided on the Site from unauthorized access, use, or disclosure. However, you are aware that, despite the above, this does not provide absolute security regarding the information you provide on the Website.

It is your responsibility to take basic protective measures on your computer or end device from which you use the Website, such as installing antivirus software, locking your computer, changing passwords, etc., in order to protect your personal information.

 

User Rights

The information will be retained in the Museum's databases for the period of time necessary for the Museum to respond and provide relevant service to the user and as long as the Museum has a legal or other need or obligation to retain it in accordance with the purpose for which it was collected and the provisions of any law. Anonymous information will be retained in the Museum's information systems indefinitely, subject to the provisions of any law.

Every user is entitled:

·         To review the information stored about him in the Museum's databases   in accordance with the provisions of Section 13(a) of the Privacy Protection Law and the Privacy Protection Regulations (Conditions for Reviewing Information and Procedures in Appealing a Refusal to Review a Request), 5741-1981. You can submit a request using an online form here.

·         After reviewing the information, the user may request to correct the information or delete it in accordance with the provisions of Section 14 (a) of the Privacy Protection Law by sending a request to the Museum using the contact details set forth below.

·         At any time, the user may remove himself from the mailing list or updates that he has consented to receive by sending a written message to info.taycm@mail.tel-aviv.gov.il.

The Museum will act in connection with the rights of users, data subjects, in accordance with the provisions of any law, however, personal information required by the Museum for various needs and for any legitimate purpose, such as defense against claims, will continue to be retained by the Museum for the time necessary for it, subject to the provisions of any law.

Direct Mailing

The Museum may send you marketing or advertising information from time to time, using the contact information you provided, in accordance with the provisions of the Communications Law (Telecommunications and Broadcasting) 5768-2008, relating to the Museum and/or its services. This information will only be sent to you if you have given your express consent to send it. This consent can be revoked in writing at any time in accordance with the "remove" option that appears in the Museum's message, and the Museum will take steps to remove you from the mailing list from which you requested to be removed.

Privacy Policy Change

The Museum may change or update this Privacy Policy at its sole discretion and subject to any law from time to time and as may appear on the Website.

Details of the Controlling Holder of the Database and Methods of Contact

The controlling shareholder of the Museum's archives is the Tel Aviv-Jaffa City Museum through the Museum's CEO, Michal Baharav. A list of the Museum's archives and their managers can be found on the Museum's Website
